The cancellation of the Sublease and Service Agreement and the refund of pre-paid amounts (including the Reservation Fee) following the payment of the Reservation Fee are subject to the following conditions.
1. Cancellation by the Subtenant (Reservation Cancellation)
- If cancellation occurs at least 15 (fifteen) days prior to the Planned Delivery Date: A penalty equal to 1/2 (half) of the Monthly Fee is applied, and the Reservation Fee is not refunded.
- If cancellation occurs between 14 (fourteen) and 1 (one) day prior to the Planned Delivery Date: A penalty equal to 1 (one) Monthly Fee is applied, and the Reservation Fee is not refunded.
- For reservations of 100 (one hundred) days and less: The cancellation policy is not applied as of the Delivery Date (meaning, no refund is made).
- All cancellation notifications must be made in writing via the e-mail address info@nook.istanbul.
2. Cancellation by the Sublessor
- The Sublessor reserves the right to cancel the reservation with a 30 (thirty) day notice period before the Delivery Date and to proportionally refund the pre-paid amount (including the Reservation Fee).
- In cases such as the leased property not being vacated until the delivery date to the Subtenant, the Sublessor may terminate the contract without penalty.
- In such a case (non-vacation), a similar property is offered. If the property offered is not accepted by the Subtenant, the Sublessor shall not be liable for compensation or penalty.
